Federal and New York State wage and hour laws, including the Fair Labor Standards Act, New York State Wage Orders, and New York State Labor Law; Compliance with and administration of Federal and New York State Leave Laws including the Family and Medical Leave Act, the New York State Paid Family Leave Law, the New York State Paid Sick Leave Law, New York State Prenatal Leave and more; Employment contracts; Reductions in force and severance agreements; and counseling and advice regarding disciplinary matters.

Employment Discrimination

Federal and New York State Discrimination Laws including Title VII of the Civil Rights Act of 1964, the Age Discrimination in Employment Act, the Americans with Disabilities Act and the New York State Human Rights Law. Training, compliance, internal investigations, advice on remedial action, defense of claims filed with administrative agencies.

About Heather A. Giambra

Ms. Giambra represents public and private sector employers and nonprofit organizations in a variety of labor and employment matters. Her traditional labor practice includes collective bargaining, contract administration, arbitration hearings and representation of employers before the National Labor Relations Board and the Public Employment Relations Board. She also represents employers in matters involving, among other statutes, Title VII of the Civil Rights Act, the Age Discrimination in Employment Act, the Americans with Disabilities Act, the Family and Medical Leave Act, the Fair Labor Standards Act, the National Labor Relations Act, the New York State Taylor Law, the New York State Human Rights Law and New York State Labor Laws. Ms. Giambra conducts workplace investigations and provides day-to-day counseling and advice and training on labor and employment related issues.

Ms. Giambra is a frequent speaker on labor and employment related topics. Including presentations for the New York State Bar Association, the Bar Association of Erie County and the Organization of Public Employer Negotiators.

Ms. Giambra is a member of the New York State Bar Association, Labor and Employment Law Section and the Erie County Bar Association, where she previously served as Chairperson of the Labor and Employment Law Committee. She is also a member of The Organization of Public Employer Negotiators.
